Terms of Service
Effective January 1, 2026.
These Terms of Service ("Terms") govern your access to and use of the Bots for Business ("BFB", "we", "us", or "our") website and AI voice and chat agent platform (collectively, the "Services"). By using the Services, you agree to be bound by these Terms. If you are accessing the Services on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.
1. The Services
BFB provides AI-powered voice and chat agents, related dashboards, integrations, analytics, and supporting services for property management operators. We may modify or update the Services from time to time. Material changes will be communicated through the Services or by email.
2. Accounts
You are responsible for the accuracy of information you provide, the security of your account credentials, and all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account.
3. Acceptable use
You agree not to, and not to permit anyone to:
- Use the Services to violate any applicable law or regulation, including fair-housing, consumer-protection, telemarketing, and call-recording laws.
- Use the Services to harass, defraud, or impersonate any person or entity.
- Reverse engineer, decompile, or attempt to extract source code from the Services, except as permitted by applicable law.
- Attempt to circumvent rate limits, security controls, or access restrictions.
- Use the Services to develop or train competing AI products or services.
- Resell, sublicense, or otherwise commercially exploit the Services without our prior written consent.
4. Customer data
"Customer Data" means information you submit to the Services or that the Services process on your behalf, including call content, transcripts, tenant and prospect information, and integration data. As between you and BFB, you retain all rights to Customer Data. You grant BFB a worldwide, non-exclusive license to host, process, and use Customer Data solely to provide and improve the Services.
You represent that you have all necessary rights, consents, and authorizations to provide Customer Data to BFB and to authorize the processing described in these Terms and our Privacy Policy. You are responsible for compliance with applicable call-recording, two-party consent, and notice requirements in the jurisdictions in which you operate.
5. SMS, MMS, and voice communications
Some of the Services involve sending and receiving SMS or MMS text messages and placing or receiving voice calls on your behalf. By using these features, you agree that:
- Consent collection. You will only authorize BFB to send messages or place calls to phone numbers from which you have collected valid consent in compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the CTIA Messaging Principles and Best Practices, and other applicable laws and carrier-imposed requirements (including those of AT&T, Verizon, T-Mobile, and US Cellular).
- Opt-out support. Every messaging campaign run on the Services will honor recipient opt-out requests received via reply keywords STOP, END, QUIT, UNSUBSCRIBE, or CANCEL, and will respond to the keyword HELP with contact information.
- Identification. Initial messages from a campaign will identify the sender by business name and disclose how to opt out and request help. Recipients will not be charged by BFB for messages, though message and data rates from the recipient's mobile carrier may apply.
- Prohibited content. You will not use the Services to send messages related to any of the SHAFT categories (sex, hate, alcohol to minors, firearms, tobacco), illegal substances, multi-level marketing, debt collection in violation of the FDCPA, or any other content prohibited by applicable law or carrier policy.
- Recordkeeping. You will maintain records of consent and opt-outs and provide them to us promptly on request, including for the purposes of responding to carrier or regulatory inquiries.
- 10DLC and brand registration. Where required by US carrier policy, you authorize BFB to register your business and applicable messaging campaigns with The Campaign Registry (TCR) on your behalf, and you will provide accurate business information for that registration.
BFB reserves the right to suspend or terminate any messaging campaign that violates applicable law, carrier policy, this section, or the rights of recipients.
6. Fees and payment
Fees for the Services are described on our pricing page or in your order form. Subscriptions are billed in advance on the cadence indicated. Per-minute voice charges and other usage-based fees are billed in arrears. All fees are non-refundable except as expressly required by law or stated in writing. Late payments may result in suspension of the Services.
7. Term and termination
These Terms remain in effect while you use the Services. Either party may terminate for material breach if the breach is not cured within 30 days of notice. We may suspend or terminate the Services immediately if you violate these Terms or use the Services in a manner that creates legal exposure for us or our users. Upon termination, your right to use the Services ceases. Sections of these Terms that by their nature should survive termination will survive.
8. Confidentiality
Each party agrees to protect the other party's confidential information using the same degree of care it uses to protect its own confidential information of like importance, and not less than reasonable care.
9. Warranties and disclaimer
Each party warrants that it has the authority to enter into these Terms. We will provide the Services in a professional manner consistent with industry standards. EXCEPT AS EXPRESSLY PROVIDED, THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUT MAY BE INACCURATE OR INCOMPLETE; YOU ARE RESPONSIBLE FOR REVIEWING AND VERIFYING AI OUTPUT BEFORE RELYING ON IT FOR BUSINESS DECISIONS.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EACH PARTY'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE FEES PAID OR PAYABLE BY YOU TO BFB IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You will defend, indemnify, and hold BFB harmless from any third-party claims arising out of or related to your Customer Data, your use of the Services in violation of these Terms, or your violation of applicable law.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in Delaware for any disputes that are not subject to arbitration.
13. Changes to these Terms
We may update these Terms from time to time. The "Effective" date at the top indicates when they were last revised. Material changes will be communicated through the Services or by email. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
